    JOHN FITZ ALAN, feudal Lord of Clun and Oswestry, Salop, son and heir of JOHN FITZ ALAN of the same, by his 1st wife, Isabel, 2nd sister and, in her issue, coheir of Hugh, and daughter of William (D'AUBIGNY), Earls of Sussex, &c, succeeded his father (whom his mother had predeceased) in 1240. To him, by writ dated 27 November 1243, was awarded [in right of his deceased mother] the Castle and Honour of Arundel, whereby [according to the admission of 1443] he must be regarded as de jure Earl of Arundel. He obtained possession, 26 May 1244, of his paternal estates in Salop on payment of £1,000. By the title, however, of Earl of Arundel he never appears to have been known [either in his lifetime or afterwards], although he lived 24 years after the acquisition of that Castle and Honour. In an award dated Friday after the Circumcision 1258, he is expressly called Dominus de Arundel [i.e. Lord of the Honour of Arundel], and in the Fine Roll, 10 March 1261/2, he is called Baro noster, while in his IPM he is described [merely] as Johannes filius Alani, and the endorsement says that he held a quarter of the Earldom of Arundel. He took part in the Welsh war in 1258, and, though sometimes leagued with the Barons against the Crown, was, while fighting on the Royal side, taken prisoner at the Battle of Lewes, in 1264, together with the King.

    He married Maud, daughter of Theobald Le Botiller, by his 2nd wife, Rohese, daughter and heir of Nicholas De Verdun, of Alton, co. Stafford. He died 1267, before 10 November. In the 42nd Henry III [1258], his lordship was made captain-general of all the forces designed for guarding the Welsh marches, and in the baronial war, he appears first to have sided with the barons, and afterwards with the king.     By his 1st wife he had a s. who was said to have been 20 in 1347, and who, if this be true, must have been begotten when his father was still very young, about 15, and 2 daughters. The grounds on which the divorce was obtained were that ' prefatus Ricardus cum eadem Isabella in eodem thoro per metum et verbera positus eandem cognovit carnaliter et filium ex ea etiam procreavit. ' (Grandisson's Register, ed. Hingeston-Randolph, p. 988) [The aforesaid Richard, when placed in the same bed by the same Isabella through fear and scourging, knew her carnally and begot a son from her.]. The same story is told in the Papal Mandate. — ' On the petition of Richard, Earl of Arundel and Isabel, daughter of Hugh Despencer, who at the respective ages of 7 and 8, not by mutual consent, but by fear of their relations, contracted espousals, and on coming to years of puberty expressly renounced them, but were forced by blows to cohabit, so that a son was born. — Mandate by canonical procedure to annul the marriage, they having constantly lived apart, and providing for their son, so that they may be free to intermarry with others. '

    It is not very easy to accept all this indecent stuff [Cokayne’s a riot] as a satisfactory explanation of a son having been born to the parties, and though in none of the documents bearing on the case is there any mention of daughters, yet there appear to have been two (see note (b) next p.), and if so, the ‘per metum et verbera ' tale breaks down altogether, unless indeed, the boy and girls were triplets ! Obviously, what really happened, was this. The powerful Earl desired to get rid of the woman to whom he had been married as a child, and who, since her father's attainder and execution, had ceased to be of any importance, that he might marry the woman with whom he was then living in adultery ; and the Pope very obligingly annulled the marriage and bastardised the issue : a very unfair proceeding as far as Edmund d'Arundel was concerned. The following Papal letters further illustrate the case, but need no comment.

    Papal dispensation 4 Mar. 1344/5 to Richard, Earl of Arundel, to remain in marriage contracted with Eleanor, daughter of Henry, Earl of Lancaster, at Ditton in King Edward's presence, though he had carnally known Isabella, related in the 3rd and 4th degree to Eleanor. — Papal mandate 31 July 1347 on petition of Edmund d'Arundel — "Earl Richard and Isabella married and begot Edmund, but Robert, Bishop of Chichester, pronounced sentence of divorce, thus bastardising Edmund ; Richard thereupon married Joan [sic] de Bellomonte daughter of the uncle [sic] of Isabella. Papal commission was issued to cite the said Richard, Isabella, and Joan, Edmund being then 18 years old. It appeared that Joan should have been called Eleanor, and that she was not soror patruelis [sister’s cousin] but neptis ex amita [granddaughter’s aunt] [sic] to Isabella. Edmund was by this time 20.   • He was the son of Richard Fitzalan, 8th Earl of Arundel and Alisona of Saluzzo, and succeeded to his father's estates and titles in 1302. Arundel bore the royal robes at Edward II's coronation, but he soon fell out with the king's favorite Piers Gaveston. In 1310 he was one of the Lords Ordainer, and he was one of the 5 earls who allied in 1312 to oust de Gaveston. Arundel resisted reconciling with the king after de Gaveston's death, and in 1314 he along with some other earls refused to help the king's Scottish campaign, which contributed in part to the English defeat at Bannockburn. A few years later Arundel allied with king Edward's new favorites, Hugh le Despenser and his son of the same name, and had his son and heir Richard married to a daughter of the younger Hugh le Despenser. He reluctantly consented to the Despenser's banishment in 1321, and joined the king's efforts to restore them in 1321. Over the following years Arundel was one of the king's principal supporters, and after the capture of Roger Mortimer in 1322 he received a large part of the forfeited Mortimer estates. He also held the two great offices governing Wales, becoming justice of Wales in 1322 and warden of the Welsh marches in 1325. After Mortimer's escape from prison and invasion of England in 1326, amongst the barons only Arundel and his brother-in-law Warenne remained loyal to the king. Their defensive efforts were ineffective, and Arundel was captured and executed at the behest of queen Isabella. Arundel married Alice, sister and eventual heiress of John de Warenne, 8th Earl of Surrey or Warenne. His estates and titles were forfeited when was executed, but they were eventually restored to his eldest son Richard Fitzalan, 10th Earl of Arundel.

    Edmund was one of a handful of noblemen who remained loyal to King Edward II when Edward's wife and her lover, Mortimer, landed in England. As a consequence, he was hanged by Mortimer, as was Hugh Despenser.     Alice de Warenne, Countess of Arundel (15 June 1287. 23 May 1338) was a noble English heiress to the Earldom of Surrey. She was the wife of Edmund Fitzalan, 9th Earl of Arundel. She was the great- granddaughter of Isabella of Angouleme, Queen-consort of King John of England, by the latter's second marriage to Hugh X de Lusignan le Brun, Count of La Marche.

    Alice was born on 15 June 1287, in Warren, Sussex, the only daughter of William de Warenne and Joane de Vere. She had an older brother John de Warenne, 8th Earl of Surrey, of whom she was heiress, to the title and estates of Surrey. Alice was born six months after her father was accidentally killed in a tournament on 15 December 1286. Her paternal grandparents were John de Warenne, 7th Earl of Surrey. and Alice le Brun de Lusignan. Her maternal grandparents were Robert de Vere, 5th Earl of Oxford and Alice de Sanford. Through her paternal grandmother, Alice de Warenne was the great- granddaughter of Queen consort Isabella of Angouleme, and Hugh X de Lusignan le Brun, Count of La Marche.

    In 1305, Alice married Edmund Fitzalan, 9th Earl of Arundel (1 May 1285- 17 November 1326). He was the son of Richard Fitzalan, 8th Earl of Arundel and Alice of Saluzzo. They had nine recorded children. Their chief residence was Arundel Castle in Sussex.

    Arundel inherited his title on 9 March 1302 upon his father's death. He was summoned to Parliament as Lord Arundel in 1306, and was later one of the Lords Ordainers. He also took part in the Scottish wars.

    The Earl of Arundel and his brother-in-law John de Warenne were the only nobles who remained loyal to King Edward II, after Queen Isabella and her lover Roger Mortimer, 1st Earl of March returned to England in 1326. He had allied himself to the King's favourite Hugh le Despenser, and agreed to the marriage of his son to Despenser's granddaughter. Arundel had previously been granted many of the traitor Mortimer's forfeited estates, and was appointed Justice of Wales in 1322 and Warden of the Welsh Marches in 1325. He was also made Constable of Montgomery Castle which became his principal base.

    The Earl of Arundel was captured in Shropshire by the Queen's party.On 17 November 1326 in Hereford, Arundel was beheaded by order of the Queen, leaving Alice de Warenne a widow. Her husband's estates and titles were forfeited to the Crown following Arundel's execution, but later restored to her eldest son, Richard.

    Alice died on 23 May 1338. She was not quite fifty-one years old. Her brother died in 1347 without legitimate issue, thus the title of Surrey eventually passed to Alice's son, Richard.

    Her many descendants included Anne Boleyn, Mary Boleyn, Diana, Princess of Wales, and the Dukes of Norfolk.
